Julien is a successful, experienced civil litigator and trial attorney who manages clients’ potential exposure in the most effective and efficient manner from before a matter’s inception until even after a trial verdict. As a Senior Counsel for the New York City Law Department for nine years, Julien managed a diverse and extensive municipal caseload in the Manhattan and Brooklyn Tort Units before serving as a senior full-time lead trial attorney for six years in the Bronx Tort Unit.  Defending the City and its agents in a variety of high-exposure negligence, labor law, intentional tort, and civil rights cases, Julien achieved an excellent record of resolving cases through defense verdicts and dismissals at trial, summary judgment victories, and negotiations of consistently favorable settlements when appropriate. Julien was recognized with a New York City Law Department Division Chief Award for outstanding trial results, and he was selected to teach legal training to fellow Law Department attorneys.

With Harris Beach’s Business and Commercial Litigation Group, Julien applies this experience to counseling corporate and municipal clients and representing them soundly and aggressively in the wide variety of their litigation needs. Julien brings invaluable prior experience as the vice president of a small closely-held corporation where he developed a personal appreciation of the concerns and needs of potential business and commercial clients. It is through this lens that Julien will apply his thorough and effective trial-based deposition, witness preparation, case development, oration, and motion practice skills that allow him to handle each litigation task with the precision necessary to advance continually each client’s position throughout the life of each dispute. Ultimately, Julien’s trial abilities help clients resolve disputes at the most favorable time and in the most successful manner, as he is confident and prepared to excel at trial if necessary.

During law school, Julien supplemented his excellent academic work with a variety of practical experiences that demonstrate his drive to learn and his commitment to the practice of law. Julien served as a judicial intern for the Hon. Michael M. Baylson of the U.S. District Court of the Eastern District of Pennsylvania and as an intern with the Antitrust Bureau and Executive Office of the New York State Attorney General’s Office under Andrew Cuomo. Julien also assisted the former Attorney General of New Jersey in counseling the 11th member of the 2011 New Jersey Voting Apportionment Commission; practiced as a student attorney at Rutgers-Newark Law School’s Constitutional Litigation Clinic; and served as an extern in the appellate litigation section of the Essex County Prosecutor’s Office.

Trial Results: 

  • Obtained a unanimous defense verdict in Bronx County Supreme Court after a hostile six-week trial with heavy exposure—due to plaintiff having undergone a spinal fusion surgery with resulting substantial permanent disability—where jury rejected plaintiff motorist’s claim that the City of New York was negligent in its direction of traffic at a Bronx construction site.
  • Prevailed in heavy-exposure trial in Bronx County Supreme Court where plaintiff claimed that he was falsely arrested and maliciously prosecuted for a drug offense, as well as sexually assaulted while in police custody.
  • Obtained unanimous defense verdict in Bronx County Supreme Court where jury found that the New York City Department of Education was not negligent in its maintenance of a school classroom door that plaintiff claimed closed too fast and severed her finger.
  • Obtained unanimous defense verdict after a month-long trial in Bronx County Supreme Court: the jury rejected as incredible plaintiff’s claim that she tripped and fell on a large cracked area of public sidewalk as a result of NYCHA’s negligence..
  • Obtained substantially limited damages verdict in Bronx County Supreme Court where plaintiff—a sleeping passenger in motor vehicle who sustained multiple serious injuries resulting in a month-long hospital stay—established 20 percent liability against the City of New York for failure to replace a stop sign at an intersection for several weeks.
  • Obtained directed verdict in New York County Supreme Court case where infant-plaintiff was injured by an allegedly defective condition that the Court found did not actually cause, but merely furnished the occasion for her injuries.
  • Background research during trial of plaintiff’s case revealed that he had filed for bankruptcy during the pendency of this lawsuit and failed to disclose this lawsuit as an asset to his creditors before the bankruptcy petition was closed: as a result, an Order to Show Cause to dismiss pursuant to CPLR § 3211(a)(3) was granted because he did not have standing or capacity to bring this lawsuit.

Summary judgment:

  • Obtained summary judgment in heavy-exposure case in New York County Supreme Court where plaintiff claimed that he was falsely arrested, maliciously prosecuted, and subject to defamation stemming from his arrest for unlawful surveillance in the bathroom of his professional office.
  • Obtained summary judgment in Kings County Supreme Court case where infant-plaintiff student was struck by a motor vehicle at an intersection near school that he claimed did not have a crossing guard present, as the Department of Education did not owe this student a special duty of care.
  • In a New York County Supreme Court case where plaintiff sustained permanent disabling injuries during an altercation, obtained summary judgment on grounds that the alleged assailant—a City of New York employee—was acting outside the scope of his employment at the time of the altercation in question.
  • Obtained summary judgment in New York County Supreme Court case involving a plaintiff motorist’s collision with a police vehicle that was engaged in active pursuit of a suspect at the time, as the Court found that the police officer did not act recklessly in his operation of the police vehicle.
